Rashtra Jyoti has officially filed a complaint with the National Human Rights Commission (NHRC) against Darshana, a woman who converted to Islam for Nikah with Mohammed Nazakat, but went on to contest and win an SC-reserved Zila Panchayat seat in Dhanpura village, Bahadarabad Block, Haridwar district, Uttarakhand.
The complaint, submitted through Dalit activist Bhupendra Pal, highlights a serious violation of Article 341 of the Constitution of India, specifically Paragraph 3 of the Constitution (Scheduled Castes) Order, 1950, which clearly states:
“No person who professes a religion different from the Hindu, the Sikh or the Buddhist religion shall be deemed to be a member of a Scheduled Caste.”
Despite undergoing an Islamic marriage ritual (Nikah) in a mosque after reciting the Kalma, as admitted by her husband Mohd Nazakat in a publicly circulated video, Darshana used a Scheduled Caste certificate to illegally access a seat reserved for Dalits, the complaint says.
“This is an electoral fraud an outright theft of Dalit rights,” said Bhupendra Pal. “We demand the immediate cancellation of her election and legal action for fraud and violation of constitutional safeguards meant for SC communities.”
Evidence Submitted to NHRC:
- A video of Nazakat publicly declaring that his wife was brought to ”Imaan” and the Nikah was conducted inside a mosque as per Islamic rituals.
- An election hoarding describing Darshana as his wife.
Rashtra Jyoti has requested following from NHRC:
- Immediate investigation into Darshana’s current religious status.
- Revocation of her election victory and disqualification from holding any SC-reserved seat.
- Legal proceedings under IPC for false representation and fraud.
- Stronger policy safeguards to prevent such constitutional violations in future elections.
This case exposes a dangerous trend where converted individuals continue to exploit SC benefits, meant only for Dalits within the Hindu, Sikh and Buddhist fold, thus denying real Dalits their rightful representation.
Rashtra Jyoti remains committed to fighting such cases of Constitutional fraud and pursuing this case to its logical conclusion.
